OPEA Celebrates Another Member Win at MPC

Another member is celebrating a victory at the Oklahoma Merit Protection Commission (Commission) after the Administrative Law Judge ruled in her favor.

 

Karla Tarango was discharged by the Department of Labor on July 17, 2009 and her case was heard by Administrative Law Judge P. Kay Floyd.  Ms. Tarango was represented by Carol Houghton from the Association’s law firm of Fellers Snider.  The Department of Labor was represented by its General Counsel, Bill Settle.

 

Judge Floyd found in her conclusions of law that the Department of Labor failed to meet its burden of proof that just cause existed to discharge Ms. Tarango for violation of Merit Rule and Department of Labor handbook.  Judge Floyd ordered Ms. Tarango to be reinstated to her position with back pay and benefits and her records be expunged of any and all documentation of the discharge.

This is good to know. I am glad that OPEA is around to help state employees. Just think what we could do if everyone joined!
