Supreme Court Rules for OPEA Members Against Okla Military Dept.

The Oklahoma Supreme Court ruled today that state agencies may not make an employee’s pay raise conditional upon leaving classified status to go to the unclassified status when it overturned an earlier Court of Civil Appeals decision. The Oklahoma Public Employees Association (OPEA) successfully sued the Oklahoma Military Department in 2012 on behalf of its members at the department who were forced to resign their classified status under the Oklahoma Personnel Act in order to receive a pay raise. However the appellate court overturned that decision. Today’s ruling overturned that appeal. The court’s ruling can be found here.
